1.About these terms
These Terms of Service ("Terms") form a binding agreement between you and Waybl ("Waybl", "we", "us") covering your use of the Waybl website, apps and services (together, the "Platform").
You must be at least 18 years old and able to enter into a legally binding contract to use Waybl. If you use Waybl on behalf of a business, you confirm you are authorised to accept these Terms for it.
These Terms include the Carrier Responsibility Clause in section 9 and incorporate our Privacy Policy, which explains how we handle your personal data.
2.What Waybl is — and is not
Waybl is a marketplace. We connect people who want to send items ("Senders") with travellers who have spare baggage allowance on a flight they have already booked ("Carriers"). We verify identities, hold payments in escrow and help resolve disputes.
Waybl is not a courier, freight forwarder, airline or customs broker. We do not take possession of, inspect, package or transport any item. Each booking is an agreement between the Sender and the Carrier, and Waybl is not a party to that agreement except as set out in these Terms.
We do not guarantee that any trip or delivery request will be matched, or that a Carrier will travel on the date listed.
3.Your account
To use most of the Platform you need an account. When you register, you agree to:
- Give accurate, current and complete information, including your legal name as it appears on your government ID.
- Keep your email address and phone number up to date so we can reach you about bookings.
- Keep your password and one-time codes private, and tell us immediately if you suspect unauthorised access.
- Hold only one personal account, and not create an account for anyone else.
You are responsible for all activity that happens under your account.
4.Identity and trip verification
Trust on Waybl depends on verification. Before you can book or carry items, you must complete identity verification by submitting a valid government-issued ID and a profile photo. A member of our team compares the document with your photo and account details.
Carriers must also submit proof of travel, such as a flight ticket and booking reference, for every trip. Trips are reviewed before they appear on the marketplace.
We may approve, reject, or ask for more information on any verification at our discretion, and we may re-verify accounts at any time. Verification reduces risk but is not a guarantee of any user’s conduct.
5.Listings and bookings
Carriers list their route, travel date, available capacity and a price per kilogram. Senders post delivery requests describing what they want to send. Either side can express interest in the other’s listing.
A booking is only confirmed when both parties agree to the match and the Sender’s payment has been received into escrow. Until then, either side may walk away without penalty.
You must keep your listings accurate. If your travel plans, capacity or item details change, update or cancel the listing promptly.
6.Fees and payments
Listing, browsing and matching are free. When a booking is confirmed:
- Senders pay the Carrier’s price for the agreed weight, plus a flat processing and escrow fee (currently $5 per booking).
- Carriers pay a refundable commitment fee (currently 20% of their listed capacity value). It is held as a deposit and returned in full when the delivery is completed successfully.
All fees are shown before you pay. Payments are processed by our payment partner, Flutterwave, and are subject to their terms. Your bank or card issuer may charge its own fees, including currency conversion.
We may change our fees with notice. Changes never affect a booking that is already confirmed.
7.Escrow and release of funds
Every booking payment is held in escrow by Waybl until the delivery is settled. Funds are handled as follows:
- Funded on confirmation: the Sender’s payment is held once both sides confirm the booking.
- Locked in transit: at handover, the Sender gives the Carrier a four-digit pickup code, which marks the start of the journey. Funds stay in escrow.
- Released on delivery: funds are released to the Carrier when the receiver confirms delivery with their code, or automatically 72 hours after the scheduled arrival if no dispute has been raised.
If a booking is cancelled before handover or no Carrier is matched, the Sender receives a refund as described in section 11. Escrowed funds do not earn interest.
8.Sender responsibilities
As a Sender, you are responsible for what you send. You agree to:
- Declare every item accurately, including its contents, weight and value.
- Only send items that are legal to export from the origin, carry in transit, and import into the destination country.
- Present items unsealed so the Carrier can inspect them before accepting, and package them safely for air travel.
- Pay any customs duties, taxes or import fees that apply to your item.
- Make sure the receiver is available to collect the item and confirm delivery.
If an item weighs more than 5% above the declared weight at handover, you must either approve a top-up payment before it travels or take the item back. Carriers are never required to carry undeclared weight.
9.Carrier Responsibility Clause
As a Carrier, you are personally responsible for everything you carry through airports and across borders. By listing a trip or accepting a booking, you agree that you will:
- Inspect every item before accepting it, and refuse anything that is sealed, unmarked, undeclared, prohibited, or that you are not comfortable carrying.
- Carry only the items and weight declared in the booking, and never accept additional items off the platform.
- Comply with your airline’s baggage rules and all customs, aviation security and import laws, including declaring items to customs where required.
- Travel on the date listed, or tell the Sender and Waybl as soon as your plans change.
- Take reasonable care of items in your possession and deliver them to the named receiver in the condition you received them.
- Hand over only to the receiver named in the booking, and complete the delivery confirmation on Waybl.
If you fail to deliver without a valid reason, damage or lose an item through negligence, or breach this clause, some or all of your commitment fee may be used to compensate the Sender, and your account may be suspended.
You may cancel a booking before handover, but repeated cancellations may affect your account standing. You are never required to carry an item you believe to be unsafe or unlawful — refusing such an item is not a breach of these Terms.
10.Prohibited items
The following items may never be sent or carried through Waybl:
- Cash and bullion
- Weapons and ammunition
- Any controlled substance
- Live animals
- Flammables and aerosols
- Prescription medication
- Perishable food
- Sealed or unmarked parcels
Also prohibited is anything illegal in the origin, transit or destination country, anything restricted by the airline, and any item whose contents the Sender will not declare. We may remove listings, cancel bookings and report activity to the authorities where we suspect prohibited items are involved.
11.Cancellations and refunds
- If no Carrier is matched, or a Carrier cancels before handover, the Sender receives a full refund of the amount paid.
- If a Sender cancels after a booking is confirmed but before handover, the Carrier’s price is refunded; the processing and escrow fee may be retained.
- Once the pickup code has been used, the booking can no longer be cancelled. Problems after handover are handled through the dispute process in section 12.
Refunds are returned to the original payment method or your Waybl wallet. Processing times depend on your bank and our payment partner.
12.Disputes between users
If something goes wrong with a delivery, either party can freeze escrow by raising a dispute within 72 hours of the scheduled arrival. Once a dispute is raised, funds stay locked until it is resolved.
Both parties will be asked to submit evidence, such as photos, messages and receipts. Waybl will review the evidence and aim to reach a decision within five business days.
Our decision determines how escrowed funds and commitment fees are distributed, and both parties agree to accept it for that purpose. It does not limit any legal rights you may have against the other party.
13.Acceptable use
You agree not to:
- Arrange payment outside Waybl for a booking made through the Platform.
- Provide false information, impersonate anyone, or use someone else’s identity documents.
- Harass, threaten or discriminate against other users.
- Post misleading listings, or scrape, reverse-engineer or disrupt the Platform.
- Use Waybl for money laundering, fraud, smuggling or any other unlawful purpose.
14.Suspension and termination
We may flag, restrict, suspend or close your account if we reasonably believe you have breached these Terms, pose a risk to other users, or are acting unlawfully. Where appropriate, we will tell you why and give you a chance to respond.
You can close your account at any time by contacting us, provided you have no active bookings or open disputes. Sections that by their nature should survive termination — including fees owed, disputes, liability and governing law — continue to apply.
15.Our liability
Because Waybl does not handle or transport items, we are not responsible for the loss, damage, delay or seizure of any item, or for the acts and omissions of Senders, Carriers, receivers, airlines or customs authorities.
To the extent permitted by law, the Platform is provided "as is", and our total liability to you for any claim relating to Waybl is limited to the fees you have paid to Waybl in the 12 months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence.
16.Changes to these terms
We may update these Terms as the Platform evolves or the law changes. If we make material changes, we will notify you by email or in the app before they take effect. Continuing to use Waybl after the changes take effect means you accept the updated Terms.
17.Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. If you live in another country, you may also benefit from mandatory consumer protections of that country, and nothing in these Terms affects those rights.
